      No, we work right around the country. Of course, it is always better to meet face-to-face, but these days with Skype it still works well. So if you are not in Cape Town we usually suggest a connection via Skype to discuss what you need and we can then do the rest via email. Would this work for you?     Good day, please advise regarding drafting of will free of charge. Do you then become the executor of such estate? What would further cost be with regards to executors hip, etc.

      Dear Carol
      Yes, we are appointed Executors in the Will. You would need a professional Executor in any case.
      Often people nominate a family member or friend as Executor, but this does not solve the problem of an executor on death, as the Master requires them to appoint a professional person as an agent – he will not appoint a lay person on their own. The only case where this is different is if the estate is small and can be dealt with under Section 18(3) – this applies to estates where the total assets are under R250 000,00.

      Executor’s fees are laid down by law and are at present 3,5% of the assets (plus VAT if your Executor is registered for VAT). We usually have a look at your cash position when drafting the Will and can work out if there may be a cash shortfall in an estate. The best way to deal with this is usually through an insurance policy, otherwise assets can be sold to meet a cash shortfall (of course, in consultation with your beneficiaries).

    Our house is paid for so no mortgage on it and is registered in both our names.What happens when one of us dies? Does it have to be re-registered and what would be the costs incurred?

    Regarding the costs in your situation, it would depend on whether you are married in or out of community of property. If you are married in, then if one of you passes away the community estate needs to be dealt with, i.e. assets in both your names form the community estate, so the full property is an asset in the estate. If you are married out of community of property, then only the half belonging to the person who has passed away is dealt with. Conveyancing costs are charged by the attorneys who handle the transfer of the property – I am not sure what these are, as they charge on a sliding scale depending on the value of the property.     P.S. The costs regarding transfer of the property are just one of the costs involved. There would also be admin costs and executor’s fees, which are 3,5% of the total value of the estate.
